The short version: MagicAgent CRM is a monthly (or annual) subscription. You own your client data. We process it on your behalf to run the service. You can cancel any time, export your data any time, and we'll delete your account within 30 days of closure. UK law governs these terms.
By creating an account or using MagicAgent CRM ("the Service") you agree to be bound by these terms. If you don't agree, don't use the Service. These terms form a legally binding contract between you and us.
"MagicAgent", "we", "us" and "our" refer to Tom Halls, a sole trader based in the United Kingdom, trading as MagicDay. "You" and "your" refer to the individual who holds the subscription, or the agency on whose behalf that individual has purchased seats.
MagicAgent CRM is a browser-based customer-relationship tool for independent Disney and Universal travel agents. A subscription gives the authorised seat-holders access to the following features while the subscription is active:
The exact feature set on each tier (Solo, Studio, agency plans) is described on the pricing page at the time you subscribe. We may add, improve or occasionally retire individual features on notice โ we'll only remove a material feature with at least thirty days' advance notice.
New accounts receive a 14-day free trial with full feature access. No payment card is required to start the trial. At the end of the trial your subscription does not auto-start โ you'll be prompted to add a payment method to continue.
If you don't add a payment method, your account becomes read-only for 30 days (so you can still export your data), after which it is deleted as described in section 10.
Paid subscriptions are billed by Stripe, our payment processor. Stripe stores your card details under PCI-DSS controls. We never see your full card number. Stripe's terms and privacy policy apply to the billing relationship separately from these terms.
You can cancel at any time from inside the CRM (Settings โ Billing) or by emailing billing@magicday.today. Cancellation takes effect at the end of your current billing period โ you keep access until then and are not charged again.
We don't pro-rate refunds for unused time on a cancelled subscription. If you believe you've been charged in error, contact us within 60 days and we'll sort it.
Everything you put into MagicAgent CRM โ your client list, trip history, notes, intake-form submissions, uploaded quote PDFs โ belongs to you. We process it on your behalf under the data-processor arrangement described in our Privacy and Data Processing document.
You are the data controller for your clients' personal data. You are responsible for ensuring you have a lawful basis (usually legitimate interest or contract performance) for collecting and processing that data, and for giving your clients an appropriate privacy notice.
At any time while your subscription is active, and for 30 days after cancellation, you can export all of your data as JSON or CSV from Settings โ Export.
You agree to use MagicAgent CRM only for its intended purpose โ managing your legitimate travel-agent business. You agree not to:
We may suspend accounts in clear breach of acceptable use, with notice where reasonably practicable.
MagicAgent CRM, its codebase, design system, branding and all associated materials remain our intellectual property. Your subscription grants you the right to use the Service โ it does not transfer ownership of the software to you.
You retain all rights to the client data, notes, quote content and agency branding you put into the CRM. You grant us a limited, non-exclusive licence to host, display and process that content solely for the purpose of providing the Service to you.
Active MagicAgent subscribers are automatically enrolled in the MagicDay partner programme at Premier tier (30%). Commission is paid on MagicDay plans purchased by your clients using your tracking code. Full programme terms โ including conversion attribution, payout thresholds and payment schedule โ are described in the partner programme terms.
If your MagicAgent subscription lapses or is cancelled, you remain in the partner programme but are moved to the standard Partner tier (25%) unless you independently qualify for Premier via conversion volume.
When a subscription ends (whether by cancellation, non-payment, or termination):

MagicAgent runs on Cloudflare's global edge network. We target high availability but do not offer a formal uptime SLA on Solo or Studio plans. Agency plans (6+ seats) include email support with a 1-business-day response target and a 99.5% monthly uptime commitment.
We may schedule maintenance windows that temporarily affect availability. Where maintenance is disruptive we'll announce it at least 48 hours in advance on status.magicday.today (when available) or by email.
The Service is provided "as is" and "as available". While we work hard to make it reliable and useful, we don't warrant that it will be uninterrupted, error-free, or fit for any particular purpose beyond general CRM use.
MagicAgent is a tool to assist your quoting and client-management process. Always verify pricing, availability and trip details directly with your clients and suppliers before confirming any booking. We are not a Disney-authorised seller and are not affiliated with The Walt Disney Company, Universal Parks & Resorts, or any other operator mentioned in the Service.
To the fullest extent permitted by applicable law, our total aggregate liability to you arising from or in connection with your use of the Service โ regardless of the basis of the claim โ is limited to the total amount you paid us in the twelve months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special or consequential damages, including lost profits, lost bookings, lost commission, loss of goodwill or loss of client data, unless such damages result from our gross negligence or wilful misconduct.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited under UK law.
We may suspend or terminate your subscription, with or without notice, if you materially breach these terms โ in particular sections 7 (Acceptable Use) or 6 (Your Data, Your Clients). Where practical we'll give you an opportunity to cure a breach before terminating.
If we terminate for breach, you will not receive a refund for the remaining portion of your billing period. You will still have the 30-day grace period described in section 10 to export your data.
We may update these terms from time to time. Material changes (anything that affects your rights, pricing, or our core obligations) will be notified by email at least thirty days before they take effect. Minor clarifications and non-material updates take effect when posted.
If you don't agree with a material change, you can cancel your subscription before it takes effect and receive a pro-rated refund for the unused portion of any prepaid period.
These terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these terms are subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in this section affects your mandatory consumer-protection rights in your country of residence.
